phky Terms & Conditions

In these Terms and Conditions, the following terms shall have the meanings set out below unless the context requires otherwise:

• "phky," "we," "us," "our" refers to the operator of the phky.asia platform, licensed and operating under PAGCOR oversight for the Philippine market.
• "Platform" refers to the phky website accessible at phky.asia, including all associated pages, games, services, and account features.
• "Player," "you," "your" refers to any natural person who registers and maintains an account on the phky Platform.
• "Account" refers to the personal account opened by a Player upon successful registration on the Platform.
• "Real Money Balance" refers to funds deposited by the Player or credited as honored winnings, available for withdrawal subject to these Terms.
• "Bonus Balance" refers to promotional credits, free spins value, or other incentive amounts credited to a Player's account subject to applicable wagering requirements.
• "Wagering Requirement" refers to the minimum total wager amount that must be placed before a Bonus Balance or associated winnings become withdrawable.
• "KYC" (Know Your Customer) refers to the identity and age verification process required by phky before processing withdrawal requests.
• "PAGCOR" refers to the Philippine Amusement and Gaming Corporation, the regulatory authority overseeing phky's operations.

By accessing the phky Platform, registering an Account, or placing any bet or wager through the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety, together with phky's Privacy Policy and Responsible Gaming Policy, each of which is incorporated herein by reference.

If you do not agree with any part of these Terms, you must immediately cease using the phky Platform and close your Account. Continued use of the Platform following publication of any amendment to these Terms constitutes acceptance of the amended Terms.

To be eligible to register and maintain an active Account on phky, you must satisfy all of the following conditions at all times:

1. You are at least 21 years of age;
2. You are a resident of or located in the Philippines or in a jurisdiction where online gambling is legally permitted;
3. You are not subject to any PAGCOR-mandated exclusion order or self-exclusion applicable to Philippine online gaming operators;
4. You are registering an Account for your personal use only and not on behalf of a third party;
5. You are not an employee, director, officer, agent, or contractor of phky or any of its software providers, and are not a close family member of any such person;
6. You have not previously had an Account on phky terminated for breach of these Terms.

phky reserves the right to request proof of age and identity at any point during your use of the Platform. Failure to provide satisfactory verification documentation may result in account restrictions, suspension, or closure. All winnings generated by an Account holder who is subsequently found to be under 21 years of age shall be void and forfeited.

To access real-money games and services on phky, you must complete the registration process by providing a valid Philippine mobile number, creating a secure password, and confirming your agreement to these Terms. Each individual is permitted to hold only one (1) Account on the phky Platform. The creation of multiple Accounts by the same individual — whether under the same or different details — constitutes a material breach of these Terms.

Prior to the processing of any withdrawal request, phky is required to conduct KYC verification. You will be required to submit:

• A government-issued photo identification document (e.g., Philippine passport, driver's license, or SSS ID);
• Proof of residential address;
• Such additional documentation as phky may reasonably require for anti-money laundering compliance or regulatory purposes.

phky will process KYC submissions within a reasonable period. Accounts that fail KYC verification, provide fraudulent documents, or are found to belong to an ineligible individual will be closed and any balance forfeited in accordance with applicable regulations. All information you provide to phky must be accurate, current, and complete. You are obligated to update your Account details promptly if any information changes.

You are solely responsible for maintaining the confidentiality of your phky Account login credentials, including your registered mobile number, password, and any one-time passcode (OTP) issued to your device. You must not share your login credentials with any third party under any circumstances.

phky will never ask you for your full password via live chat, email, or any other communication channel. Any communication purporting to be from phky that requests your password should be treated as fraudulent and reported immediately.

You must notify phky immediately via the in-account live chat support if you suspect or become aware of any unauthorized access to or use of your Account. phky shall not be liable for any losses arising from unauthorized Account access where such access results from your failure to keep login credentials confidential, unless phky has been grossly negligent in its own security obligations.

phky reserves the right to lock or suspend an Account as a precautionary security measure if unusual login activity or suspected unauthorized access is detected, without prior notice to the Account holder.

phky accepts deposits and processes withdrawals via the following payment methods: GCash, PayMaya (Maya), BPI, BDO, and Metrobank. All transactions are denominated in Philippine Pesos (PHP / ₱). Minimum deposit amounts and minimum withdrawal amounts are as published in your account dashboard and are subject to change with notice.

Deposits: Funds deposited to your phky Account are credited upon confirmed receipt by phky's payment processing systems. phky is not responsible for delays caused by third-party payment providers, banking systems, or telecommunications infrastructure. phky does not accept cash deposits or deposits from third-party accounts not registered in your name.

Withdrawals: Withdrawal requests are subject to the following conditions:

• Your Account must have completed KYC verification;
• The withdrawal amount must not exceed your available Real Money Balance;
• Any active Bonus Balance wagering requirements must be completed or the Bonus Balance forfeited before the corresponding funds become withdrawable;
• phky reserves the right to conduct additional security or fraud checks on withdrawal requests, which may extend processing times;
• Withdrawals will be processed to the same payment method used for deposit wherever technically possible.

phky does not charge fees on standard withdrawal requests. Third-party payment providers may impose their own fees, for which phky accepts no responsibility. Target processing times are published in the platform but are not guaranteed and may be affected by factors outside phky's control.

phky may from time to time offer Players promotional bonuses, free spins, cashback, reload offers, or other incentives (collectively, "Promotions"). All Promotions are subject to the specific terms published alongside each offer ("Promotion Terms"), which form part of these Terms. In the event of conflict between Promotion Terms and these general Terms, the Promotion Terms shall take precedence with respect to that specific Promotion.

General conditions applicable to all phky Promotions, unless expressly stated otherwise in the applicable Promotion Terms, include:

• Promotions are available to eligible phky Account holders only and are not transferable;
• A Player may not hold multiple Accounts in order to claim a Promotion more than once;
• Bonus Balances are subject to the wagering requirement specified in the Promotion Terms before withdrawal is permitted;
• Wagering on live baccarat, roulette, blackjack, and other specified games may contribute at a reduced percentage toward wagering requirements, as specified in the Promotion Terms;
• Bonus Balances that have not been used within the expiry period specified in the Promotion Terms will be forfeited without compensation;
• phky reserves the right to withdraw, modify, or cancel any Promotion at any time with reasonable notice to affected Players;
• phky reserves the right to withhold or recover Promotion benefits if it has reason to believe that a Player has abused or manipulated a Promotion, including through collusion, use of multiple accounts, or systematic exploitation of bonus mechanics.

All games available on the phky Platform are operated by certified third-party game providers and use certified Random Number Generator (RNG) technology or live dealer systems that produce independently verifiable and audited outcomes. phky does not control individual game outcomes and does not intervene in the game mechanics operated by its licensed providers.

Published Return to Player (RTP) percentages represent theoretical long-term averages across a large number of game rounds and do not guarantee any specific outcome for any individual player or session. Past game results do not predict future outcomes.

In the event of a technical malfunction, disconnection, or system error during a game round:

• phky will use commercially reasonable efforts to determine the game state at the point of malfunction;
• If a game round cannot be completed or reconstructed, the stake for that round will be returned to the Player's account;
• phky's decision regarding malfunction outcomes is final, subject to the dispute resolution process set out in Section 14.

Bets placed and confirmed by the platform prior to any malfunction are honored in accordance with the game outcome. phky reserves the right to void any bet placed at manifestly incorrect odds or as a result of a clear pricing error.

The following conduct is strictly prohibited on the phky Platform and constitutes a material breach of these Terms:

• Registration of more than one Account by the same individual;
• Providing false, misleading, or fraudulent information during registration, KYC, or any other interaction with phky;
• Using the phky Platform for money laundering, fraud, or any other criminal activity;
• Collusion with other Players to gain an unfair advantage in any game;
• Use of automated software, bots, scripts, or other artificial intelligence tools to interact with the Platform, place bets, or exploit game mechanics;
• Exploiting errors, bugs, or vulnerabilities in the Platform for financial gain without promptly reporting the issue to phky support;
• Systematic exploitation of Promotion mechanics in a manner not consistent with normal recreational gameplay, including but not limited to matched betting conducted specifically to abuse phky's promotional offers;
• Allowing or assisting any person under 21 years of age to access or use your Account;
• Sharing, selling, or transferring your Account to any third party;
• Making chargebacks or reversals on deposits without legitimate grounds, after using the deposited funds for gameplay.

phky reserves the right to suspend or permanently close any Account involved in prohibited conduct, void related transactions, and report conduct to PAGCOR or Philippine law enforcement authorities where required by law or regulatory obligation.

All content on the phky Platform — including but not limited to the phky brand name and logo, website design and layout, text, graphics, software, game interfaces, and all associated intellectual property — is owned by or licensed to phky and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the phky Platform for personal, non-commercial entertainment purposes only. This license does not permit you to copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any phky content without phky's prior written consent.

Game content provided by phky's licensed providers (including Evolution, Pragmatic Play, PG Soft, and others) remains the intellectual property of those respective providers and is subject to their own licensing terms.

To the maximum extent permitted by applicable Philippine law, phky's total liability to you arising out of or in connection with your use of the phky Platform — whether in contract, tort, or otherwise — shall be limited to the amount you deposited with phky in the twelve (12) months immediately preceding the event giving rise to the claim.

phky shall not be liable for any:

• Indirect, incidental, consequential, or punitive damages;
• Loss of profits, opportunity, or anticipated savings;
• Losses arising from your failure to comply with these Terms;
• Service interruptions caused by force majeure events, including natural disasters, telecommunications failures, government actions, or other events beyond phky's reasonable control;
• Losses arising from third-party payment provider delays or failures.

Nothing in these Terms excludes or limits phky's liability for fraud, death or personal injury caused by phky's negligence, or any other liability that cannot be excluded under Philippine law.

phky is committed to promoting responsible gambling and provides a suite of account-level tools to help Players manage their gaming activity. All Players are encouraged to use these tools proactively rather than reactively. The following responsible gaming features are available to all phky Account holders:

• Deposit Limits: Set maximum deposit amounts at daily, weekly, or monthly intervals. Reductions take effect immediately; increases are subject to a 24-hour cooling period.
• Loss Limits: Define the maximum net loss permitted within a defined period. Activating or reducing a loss limit takes effect immediately.
• Session Time Reminders: Configure notifications to alert you when you have been playing for a specified duration.
• Cooling-Off Periods: Temporarily suspend your Account for 24 hours, 72 hours, 7 days, 30 days, or 6 months. During a cooling-off period, your Account is inaccessible for gameplay and you may not request the early reversal of the restriction.
• Self-Exclusion: Permanently exclude your Account from the phky Platform. Self-exclusion is irreversible and phky is obligated to take all reasonable steps to prevent re-registration of an excluded Player.

phky reserves the right to suspend, restrict, or permanently close any Account at its reasonable discretion, including (without limitation) in the following circumstances:

• Breach of any provision of these Terms;
• Failure to complete or pass KYC verification within a reasonable period after being requested;
• Reasonable suspicion of fraudulent activity, money laundering, or collusion;
• Discovery that the Account holder does not meet the eligibility requirements set out in Section 3;
• Receipt of a regulatory direction from PAGCOR or other competent authority;
• Extended inactivity (as defined in the platform's dormancy policy published in your account dashboard).

Where an Account is closed due to a breach of these Terms, phky reserves the right to withhold the Account balance pending investigation and, if the breach is established, to forfeit the balance. Where an Account is closed for any other reason, any verified Real Money Balance will be returned to the Player via their registered payment method following completion of any required compliance checks.

You may close your phky Account at any time by contacting the 24/7 live chat support team from within your Account dashboard. All pending bets at the time of Account closure will be resolved in accordance with their normal game outcomes.

If you have a complaint or dispute regarding the phky Platform, you must first contact phky's customer support team via the in-account live chat channel. phky will acknowledge your complaint within one (1) business day and aim to provide a substantive response within five (5) business days. Complex complaints may require additional time, and phky will communicate any extension to you in writing.

If your complaint is not resolved to your satisfaction through phky's internal process, you may escalate the matter to PAGCOR as the relevant regulatory authority for Philippine-licensed online gaming operators. phky will cooperate fully with any PAGCOR investigation or mediation process initiated in connection with a Player complaint.

You agree that prior to initiating any formal legal proceeding, you will allow phky's internal dispute resolution process to complete in full. This requirement does not affect any statutory rights you may have under Philippine consumer protection legislation.

phky reserves the right to amend, modify, or replace these Terms at any time. When material changes are made, phky will notify affected Players by publishing the updated Terms on the Platform and, where reasonably practicable, by notifying active Account holders via their registered contact details.

The "Last Updated" date shown at the top of these Terms will reflect the date of the most recent revision. It is your responsibility to review the current version of the Terms periodically. Your continued use of the phky Platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not accept an amendment, you must stop using the Platform and request Account closure in accordance with Section 13.

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

The parties agree to submit to the exclusive jurisdiction of the competent courts of the Philippines for the resolution of any legal proceedings arising from or related to these Terms, the phky Platform, or the relationship between phky and any Player. This jurisdiction clause does not affect any mandatory consumer protection rights available to Players under Philippine law that cannot be contractually excluded.

phky operates in compliance with all applicable Philippine laws and regulations, including Republic Act No. 9287, Republic Act No. 9175, and all relevant PAGCOR implementing rules and regulations as amended from time to time.
